Weather-Related Auto Accident Injuries

Posted on Friday, January 6th, 2017

During those winter months, the road conditions can become quite dangerous. With dangerous road conditions, the chances of rear ending another vehicle or getting rear ended increase dramatically. Although we all do the best we can to be prepared for driving in wet or icy conditions, sometimes there is nothing we can do to prevent someone from smashing into the back of our vehicle. The majority of rear-end accidents result in an injury to more than one person, and that injury is usually whiplash, which can produce a number of other conditions. However, in more severe auto accidents where one vehicle rear ends another, the injury suffered by the victim can be life altering. In either situation, after an auto accident, a person should always seek medical attention to ensure that there are no underlying injuries that they haven’t felt yet. Sometimes, an injury may not be noticeable until a few days or weeks after the auto accident. At the same time, you should also seek the counsel of a personal injury attorney to help you file a personal injury claim.

At Amerio Law Firm in Sacramento, we have helped hundreds of people receive damages for the auto injuries they suffered after being rear ended on the road. If you’ve been involved in an auto accident where the other driver rear ended you, depending on your situation, you may be entitled to compensation. Call Amerio Law Firm in Sacramento at (916) 419-1111 to schedule an appointment with one of our personal injury attorneys today.

According to the Department of Transportation, Road Weather Management Program, “On average, nearly 6,000 people are killed and over 445,000 people are injured in weather-related crashes each year,” which is based on data provided by the National Highway Traffic Safety Administration (dot.gov, 2016). Additionally, of the weather-related crashes that occur, wet pavement was a factor in 73 percent with rainfall contributing 43 percent of the wet pavement accidents (nhtsa.gov, 2016). Winter conditions also play a factor in weather-related auto accidents where “17% [occur] during snow or sleet, 13% occur on icy pavement and 14% of weather-related crashes take place on snowy or slushy pavement” (dot.gov, 2016). In many cases, the city, county, or government cannot be held liable for the road conditions because it was your choice to drive on it. However, the one that can be held liable is the driver that crashed into the back of your vehicle. That’s where an experienced personal injury attorney comes to your aid.

Our top priority at Amerio Law Firm is to ensure that our clients are getting the medical attention that they deserve to recover properly from their injuries. Time is of the essence with personal injury cases, so don’t wait. Posted on Thursday, December 29th, 2016

New Year’s Eve is a time for celebration and parties with friends or family. While many intend on bringing in the new year with celebration, the possibility of trouble is far off. While most will do what they can to make New Year’s Eve a wonderful night to remember, others seem to be determined on making the memory a little more tragic by causing trouble or driving drunk.

Every year, there are a significant amount of people who drive drunk, which increases the amount of auto accident fatalities more any other time of the year. In fact, according to the National Highway Traffic Safety Administration (NHTSA), “on average, over 10,000 people have died each year (2010 to 2014) in drunk-driving crashes” (nhtsa.gov, 2016). Even with these statistics, people still overindulge in alcohol and still get behind the wheel.

  1. DO NOT DRINK AND DRIVE!
  2. Make sure to have a designated driver. Uber, Lyft, and all taxi services will be in full force that night, so make sure to have a few options.
  3. If you do drink, pace yourself and drink one glass of water between strong drinks.
  4. With champagne, make sure to point the bottle at 45-degree angle away from guests.
  5. Have a full and filling dinner before going out. This will help absorb the alcohol.
  6. If you are going to the club or bar, be wary of your drink and don’t lose track of it (this goes for both men and women).
  7. Go out with a group, don’t go out alone.

From all of us at Amerio Law Firm, we would like to wish you all a safe and eventful New Year’s celebration. Wrongful Death Lawsuits

Posted on Thursday, December 22nd, 2016

“Tis impossible to be sure of anything but Death and Taxes.”

This line was penned in 1716 by an English playwright named Christopher Bullock in his short play titled “The Cobbler of Preston.” Several years later, this line was mimicked and even recreated by other authors and even mentioned in a letter that President Benjamin Franklin authored in 1789. The unfortunate truth of this line is that death is certain. However, if that death was caused by the fault of another person or company, in today’s legal system, there are measures that can be taken that can provide compensation for those left behind after the death of a loved one. This is what we call a wrongful death lawsuit.

The purpose of a wrongful death lawsuit is to provide compensation to the loved ones and dependents of the person who passed away to help cover medical expenses, funeral expenses, lost wages from the deceased, and even for emotional hardship. For instance, if the only source of income for the family is provided by the mother and she is killed by a defective part on her car that caused an auto accident, her family may be able to sue the auto maker for damages, depending on the situation of the auto accident.

Auto accidents are just one example of why to file a wrongful death claim. Other types of fatal accidents may include medical malpractice, product liability, and property hazards. Also, people, companies, and different agencies can be held accountable for their negligence or recklessness that caused the accident, resulting in the death of another person. It’s DUI Season

Posted on Monday, December 5th, 2016

Driving Under the Influence

Every year, people tend to overindulge in the festivities, and many times the consequences are auto accidents and DUI’s. With the number of drunk drivers on the roads during the holidays, one would suspect that being on the road during this time of year would be a dangerous time. Unfortunately, that would prove to be correct according to the National Highway Traffic Safety Administration, which suggests a higher volume of holiday travelers combined with a greater number of drinking and driving incidents has the potential to produce twice as many automotive deaths during the holiday season compared to the rest of the year.

Although many studies have published statistics that indicate a low number of drinking and driving auto accident fatalities on Christmas day, that number is greatly contrasted by the high number of fatal auto accidents on Christmas Eve, which is a day when people are more likely to overindulge in alcohol during a holiday party. New Year’s Eve, on the other hand, is the day when an average of more than 42 percent of auto accidents are resulted from drinking and driving. Yet, when it lands on a weekday, that percentage drops significantly. Furthermore, people who don’t normally drink will also engage in the consumption of alcohol, their low tolerance can also affect their driving ability without them knowing, which increases their risk of being involved in an auto accident.

From all of us at Amerio Law Firm in Sacramento, we’d like to remind you to drink responsibly during the holiday season and do not drink and drive. However, if you have gotten in trouble for DUI, there is a possibility that our services may of benefit to you, depending on your case. If you have been involved in an accident that was caused by a drunk driver, you may be entitled to compensation for your injuries.
